General Terms and Conditions of Product and Service On-Line Selling

The on-line selling is subjected to the discipline of D. Lgs. May 22nd 1999 n. 185 "Attuazione della direttiva 97/7/CE relativa alla protezione dei consumatori in materia di contratti a distanza".

1. Subjects.

Service Provider: Distretto Turistico dei Laghi, Monti e Valli Scrl - Corso Italia 18 - 28838 Stresa (Verbania) - Italy - following DTL.
Customer: the individual identified by data filled in the request of on-line purchase – about that see corresponding guarantees in article 6.

2. Service object.
The product or service purchase is carried out by transmitting on-line customer’s personal information and paying by credit card or bank transfer.

For products and services directly provided by DTL, the order is dispatched immediately in 48 working hours. For products and services sold with DTL, the order is dispatched within the timings indicated by corresponding providers.
Referring to the sale of the "Seasonal VCO Neveazzurra Ski Pass", the delivery of ski passes reserved by pre-sale will by the 8th December 2010.
After order dispatching, no refunds will be possible and no complaints due to Customer’s errors in filling the form and/or communicating order data will be accepted (i.e. wrong name and/or fiscal code).

3. Prices.
If not specified in writing, all prices have to be intended "including VAT".

4. Payment.
Payment must be made by credit card (Visa, MasterCard, PostePay or Carta Aura) through PayPal gateway of on-line payment with 128 bit-cryptographic system.

The payment gateway is managed by PayPal.

The Customer is informed that the on-line payment is considered as perfected only after that, following his/her order confirmation, the Istituto di Moneta Elettronica (IME) has consented to use the credit card.

In case of payment by bank transfer, the payment is considered as perfected only after transfer credit to Provider’s account. The Customer is allowed to anticipate a copy of the receipt of completed bank transfer by e-mail (infoturismo@distrettolaghi.it) or fax (+39 0323 934335) marking the CRO number.

Summary scheme:
Phase 1: Order sending by Customer;
Phase 2: Customer’s request for card authorization to PayPal or credit of Customer’s transfer to Provider’s account.
Phase 3: Provision of the ordered product or service to Customer.

A negative answer in Phase 2 causes the immediate block of order and of debit of relating costs to Customer (non-confirmed transaction).

The Customer is informed that the order and its payment will be received by DTL through its own informational system and – for products or services not provided directly by DTL – sent to the service Provider. The Provider will dispatch the order by accessing to the databases of producers and administrative institutes in charge and emit receipt-invoice to be paid by the Customer. The order so dispatched and the relating invoice will be sent to the Customer by Distretto Turistico dei Laghi, Monti e Valli Scrl, which act under trust mandate of the Provider.

5. Withdrawal right.
The service Provider, under the D. Lgs. 185/99 (“Tutela dei consumatori nei contratti conclusi a distanza”), informs the Customer as following. Under the clause 5, paragraph 3) of D. Lgs. 185/99 as the service is normally carried out within 24 hours, with Costumer’s agree and, anyway before the end of 10 working days-deadline since the order conclusion. The refund will take place on simple Customer’s request, deducting the on-line transaction fee equal to 4% of total amount, with a minimum of € 3,50=, the delivery charges as well as the administrative expenses equal to € 25,00=, in addition to possible prepayments in Customer’s name and on Customer’s behalf.

6. Guarantees given by the Customer.
The Customer guarantees, assuming every relating responsibilities and keeping DTL, as intermediary, uninjured from every prejudicial consequences, that his/her personal information, given by accepting these general terms and conditions, are true and let individuate Customer’s true identity. Moreover, the Customer commits him/herself to inform immediately the Provider, in writing or even by e-mail, about any variations of given information.

7. Responsibility restrictions.
Any information relating to products sold by the Provider based exclusively on information published and communicated by their respective producers. DTL doesn’t assume any direct, indirect or consequent responsibility referring to information given by producers or service providers.

8. Communication.
The Customer accepts that the notification and the communications relating to all on-line services are carried out by the Provider in electronic format (e-mail), recognizes their full validity and expressly renounce hereafter disowning the content of the declarations sent and/or received in electronic format. The Customer is informed and accepts that DTL keeps technical Log Files stored in its information system about the traceability of on-line operations as well as of all activities carried out on the websites www.distrettolaghi.it and www.lagomaggiore.it and he/she recognizes their validity in order to reconstruct possibly the existing relations. The Customer expressly authorizes Distretto Turistico dei Laghi SCRL to handle his/her personal data for all operations related to on-line selling.

9. Enforceable Law.
Italian Law is exclusively enforced for all services of ON-LINE SELLING available on the websites www.distrettolaghi.it and www.lagomaggiore.it.

10. Complaints, information and suggestions.
Complaints, information and suggestions can be sent by certified mail AE to:

If the complaint is referred to a carried-out order, please specify its details (i.e. number, date) and attach the copy of the order confirmation already printed or received via e-mail.

Under the clauses 1341-1342 C.C. the Customer declares to have carefully read and to accept specifically the terms and conditions under the following clauses regarding the on-line service given by Distretto Turistico dei Laghi Scrl: 5 (exclusion of Withdrawal right); 6 (Guarantees given by the Customer and his/her responsibility assumption); 7 (responsibility limitations); 8 (electronic communications validity and Customer’s renunciation disowning their content).
